These Terms of Service (“Terms”) govern your access to and use of EnjoyLB.com, including our website, mobile applications, and communications (collectively, the “Service”). By using the Service, you are entering into a binding contract with EnjoyLB.com (referred to as “we,” “us,” or “our”).

PLEASE NOTE: THESE TERMS INCLUDE A BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER (SECTION 11). THEY AFFECT YOUR LEGAL RIGHTS. PLEASE READ THEM CAREFULLY.

1. DEFINITIONS

User: Anyone who accesses or uses the Service.
Content: Text, images, photos, and all other forms of data.
Our Content: Content we create, including the selection, coordination, and arrangement of business listings, happenings, and event data.
Third-Party Content: Information fetched from Google Business listings, business website crawls, or other external sources.

2. SERVICE ACCURACY AND AVAILABILITY

No Claim to Accuracy or Exhaustiveness: EnjoyLB.com provides information about local businesses, community events, and local resources (e.g., beach info, sanitation, transportation) for convenience only. Much of this data is automated via web crawls and external databases. We make no claims, promises, or guarantees about the accuracy, completeness, exhaustiveness, or timeliness of the information provided.
"As-Is" Basis: We do not audit every listing. We are not responsible for inaccurate hours, closed businesses, missing listings, or canceled events. Your reliance on any information found on the Service is strictly at your own risk.
Service Changes: We may modify, update, suspend, or discontinue any part of the Service at any time without notice.

3. ELIGIBILITY AND ACCOUNTS

Age: You must be at least 13 years old to use the Service.
Business Accounts: If you claim a business listing or purchase a "Rich Profile" or "Featured Slider," you agree to provide accurate, up-to-date information. You are responsible for all activity occurring under your account.

4. CONTENT PERMISSIONS

Your Contributions: If you submit a photo, event, or correction, you grant EnjoyLB.com a worldwide, perpetual, non-exclusive, royalty-free right to use, reformat, and display that content across our platform and media channels.
Ownership: You own your original content. We own the "EnjoyLB.com" branding, site design, compiled business directory, and features.

5. PROHIBITED CONDUCT

You agree not to:

Use automated systems, robots, or "scrapers" to extract data from EnjoyLB.com for commercial purposes.
Post fake reviews or intentionally misleading information about a local business or event.
Attempt to gain unauthorized access to our servers, infrastructure, or other users' accounts.

6. BOOKING AND EXTERNAL LINKS

The Service may include "Order Online," booking, or ticketing links. These transactions are strictly between you and the third-party business. EnjoyLB.com does not process these payments and is not responsible for order fulfillment, customer service, or refunds.

7. ADVERTISING AND SPONSORSHIPS

We may feature local businesses through paid "Featured Category Sliders," "Rich Profiles," or sponsored placements. The presence of a sponsored listing does not constitute an endorsement or recommendation by EnjoyLB.com.

8. INDEMNITY

You agree to indemnify, defend, and hold harmless EnjoyLB.com and its representatives from any claims, actions, or damages (including legal fees) arising from your use of the site, your violation of these Terms, or any content you submit.

9. DISCLAIMERS AND LIMITATION OF LIABILITY

The Service is provided "As-Is" and "With All Faults." EnjoyLB.com is not liable for any loss or damage arising from your reliance on business listings, event details, or local schedules.
Maximum Liability: In no event shall EnjoyLB.com’s total liability to you exceed $100 or the amount you paid us (if any) in the last 12 months.
Consequential Damages: We are not liable for indirect, incidental, or consequential damages, lost profits, or business interruption.

10. CHOICE OF LAW

These Terms are governed by the laws of the State of New York. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Nassau County, NY.

11. DISPUTE RESOLUTION (ARBITRATION & CLASS ACTION WAIVER)

Any dispute arising out of or relating to these Terms or the Service shall be settled by binding, individual arbitration in Nassau County, NY. You waive your right to participate in a class-action lawsuit or class-wide arbitration against EnjoyLB.com.

2. Additional Terms for Business Accounts

These Additional Terms for Business Accounts (“Business Terms”) govern your access to and use of the business-specific features on EnjoyLB.com. By creating a Business Account, claiming a listing, or purchasing a Sponsorship Package, you agree to these Business Terms in addition to the main Terms of Service.

1. REPRESENTATIONS AND WARRANTIES

By accessing or claiming a Business Account, you represent and warrant that:

You are the owner or an authorized representative of the business or entity listed.
All information provided for your Rich Profile (hours, address, contact info) is accurate and will be updated by you as changes occur.
Any promotional content, logos, or images you upload for Featured Sliders do not infringe on the intellectual property rights of any third party.

2. SPONSORSHIP PACKAGES AND PAYMENTS

Services Provided: EnjoyLB.com offers various paid services, including Featured Category Sliders, Rich Profiles, and prominent placement of Online Ordering/Booking buttons.
No Guarantee of Results: We do not guarantee a specific number of clicks, impressions, or increased revenue resulting from your sponsorship. Sponsorship provides placement visibility, not a guaranteed financial outcome.
Billing: All fees are non-refundable unless otherwise stated in writing. We reserve the right to change our pricing upon 30 days’ notice.

3. ONLINE ORDERING AND EXTERNAL LINKS

Third-Party Facilitation: If your Rich Profile includes an "Order Online" or "Book Now" button, you acknowledge that EnjoyLB.com acts solely as a referral gateway.
Liability: EnjoyLB.com is not responsible for the fulfillment of orders, customer service disputes, payment processing errors on your platform, or the functionality of your external website.

4. DATA FETCHING AND CRAWLING

Consent to Crawl: You grant EnjoyLB.com permission to crawl your official business website or public profiles to keep your listing details (like menus or event dates) updated.
Accuracy: While we attempt to sync data accurately, it is your responsibility to verify the "fetched" information on your profile. You agree to hold EnjoyLB.com harmless for any display of outdated information pulled from public web sources.

5. TERMINATION OF SPONSORSHIP

Our Right to Remove: We reserve the right to remove a Featured Slider or Rich Profile if the content is deemed offensive, illegal, or if the business has permanently closed.
Payment Failure: Failure to pay sponsorship fees will result in the immediate reverting of your profile to a "Standard Listing" and the removal of all featured placements.

6. LIMITATION OF LIABILITY FOR BUSINESSES

EnjoyLB.com shall not be liable to you for any indirect, incidental, or consequential damages, including loss of profits or business interruption, arising from the temporary unavailability of the site or the accidental removal of a sponsored listing. Our maximum aggregate liability to any Business Account is limited to the total amount paid by you to EnjoyLB.com in the six (6) months prior to the claim.

7. MODIFICATION OF BUSINESS SITE

As EnjoyLB.com grows, we may update the site layout, category structures, or display algorithms. We do not guarantee that your sponsored placement will appear in the exact same pixel location or format for the duration of your sponsorship.
